遇到无良屋主 我需要咨询有关法律问题 (最终关头 我应该怎么做呢)

其实他contract里写我租RM750罢了。。但是过后他讲Indah water我们要负责。每个月要我们多给RM8。
而且给了还不用紧。他竟然没交到indah water每次都收到Indah ...
不用担心,白蚁这个问题是有争议性的。。standard的租约一般上的确都会要求租户在期间维持屋子的良好状况(除了合理的wear n tear)...但同时,屋主也有责任提供可居住的环境给租户。 这个时候,白蚁几时开始出现,和是否是租户造成/或疏忽造成的,就成了关键问题了
至于indah water, 就看合约里是否有要求你负担了。。。你的有包水电吗?如果没有的话,通常会有一段要求你自己申请和负担各种杂费的。。。倒是就看如何诠释条款了 |

我最后一张收到的是
as you are aware,your tenancy contract terminates on 31 March 2008 at your given notice
As such, i would wish to remind you of some of your contractual obligations resulting from the tenancy termination:
1.rented domicile to be returned in similar condition when initially rented less reasonable wear and tear. required cleaning to have been done upon vacating;
2.furniture & fittings within rented premises to be returned in similar condition when initially rented in serviceable condition with any condition on fixtures requiring servicing to have already been carried out with documented evidence,less reasonable wear and tear;
3.electrical appliances including air-conditioning unit within rented premises to be returned in similar condition when initially rented in serviceable condition less reasonable wear and tear with general servicing to have already been carried out at least once during tenure of tenancy with documented evidence;
4.all cost of consumables and utility bills to have been settled or in the process of being settled;
5.to give vacant possession of rented domicile area upon surrendering of all access including removal of all personal possessions from the entire property.
upon satisfactory compliance of all the conditions above,your deposit will be refunded.
那么意思是不是说 如果我没有跟据以上的条例
然后我就拿不回我的deposit呢? |

租户在租约完结后将屋子还给屋主的时候,必须是一开始时的样子。 |

我不懂法律,但是我也参一脚来发表意见,小弟知道,口头承诺是有法律效应的,sms 收到承认的可能性很高,最近小弟正在看一部电视剧《古灵精探》,里面有说到,sms 来来电显示,可以证明短信息从机主的手机发送出。
马来西亚是全球首个手机机主需要需要注册的国家,如果当初屋主用真实资料注册,那个电讯公司是有资料的。只要时间符合,那个sms 就是一个证据了。如果手机有对话的录音,可能更好,从语气中可能找到威胁的口气,更何况他说的是英文,我国国家机构可能不承认中文,但是每个人都听得懂英文吧?
如果你英文差,屋主还是在强迫你,威胁你,在没有通知下进行其他服务,突然的要你付款,我想这叫做 ‘ 误导,引诱 ’ , 这是属于欺骗性质吧?

没办法了 我已经踩下了根据renew时所增加的陷阱
所以决定自己叫人来service冷气给他了
只是现在我担心的是
他有没有权利要求要贵的survice呢?
有没有权利要换这个零件 那个零件 然后全部算我的呢?

那时说renew的时候你同意了? 那就只好遵守了
既然这样,不如你自己找人替他 service (当然他可能会故意挑剔)。。。
如果是他找人service, 当然再没有注明下都应该是reasonable 而不能过分的
至于如何才是reasonable, 则需要入禀法庭了 |

现在我已经交所有的keys和东西了
可是他还没有还我任何的deposit
他说他要满意所有的东西先
我应该怎么做?
他是以这个来讲
the sum of ringgit malaysia four hundred only (hereinafter referred to as the security Deposit) as security for the due observance and performance bt the Tenant of the terms and conditions of this Agreement which sum shall not be deemed to be or treated as payment of rent in any circumstances and the same shall be refunded to the tenant upon the expiration of the said Tenancy PROVIDED that the Tenants Obligations contained herein shall have been prtformed and observed. The tenant agrees that this sum shall be held by the landlord during the continuance of the tenancy until expiry. |
