孟山都除草劑致癌 賓州受害人賠款降至4億

孟山都甘草磷除草劑(Roundup)致癌案，法官將賓州受害人麥季文森(John McKivison)的賠償金額從22.5億元降為4億元，降幅超過80%。

今年1月，法院陪審團宣判，孟山都應賠償使用Roundup長達20年而罹患血癌的利康明郡原告22.5億元，其中20億是罰金，2.5億是傷害補償金。

費城上訴法院法官舒爾曼(Susan Schulman)日前將陪審團判賠金額降至4億，包括5000萬傷害賠償金和3.5億罰金。

替麥季文森打官司的兩位律師說，會替客戶提出上訴。

費城克萊恩與史貝克特律師事務所以及休士頓阿諾德與伊特金律師事務所的律師說，他們很高興法官推翻了孟山都多次想要破壞陪審團判決的企圖。陪審團的判決很清楚：甘草磷除草劑是致癌產品。

「但我們也相信，降低陪審團判賠金額，明顯背離了賓州既有的法律，因此，我們打算上訴，藉此恢復陪審團原訂的賠款，並遏阻孟山都賣致癌物給不知情消費者，卻毫無歉意的行為。」

孟山都的德國母公司拜耳集團1月獲悉陪審團判陪22.5億後，就宣稱要上訴，因為賠償金額大到「違憲」的程度。即使法院已將賠償額減為4億，孟山都仍說要向賓州高等法院上訴。

孟山都說，儘管賠償金額減低，「我們仍不同意，因為審判過程充斥重大且可逆轉的錯誤，這些錯誤誤導也煽動了陪審團。」

孟山都堅持Roundup除草劑安全，強調科學研究與評估，都支持「含甘草磷的產品很安全」的說法。
