我被解雇 了..!!

我在案一间本地建筑材料厂家工作,本人在这个月收到了公司的解雇信理由是habitually late and unsatisfied performance..而在此之前我并没有受到任何的警告信(口头或书信)...

而我的工司也拖欠了我四个月的工积金...

请问我可否采取法律行动??

如果可以的话我应该从那里着手??

你快快去sue他。。。。去print out 你的工积金的statement

最终我忍无可忍于是我写了一封信

I refer to your termination letter dated 14/10/2009which I received onthe 22/10/2009. I am disputing the reasons that youhave stated in the letter which are,

1)
Habitual late
2)
Unsatisfactory performance

I wish to state that from all the duration of timesduring under the employment of your company, I have never been late towork except for the very few occasions which I have always providesearly notification to the person incharge of me. There are also certaintimes that I have always provides early notification of earlyappointment with clients via my daily visitation reports handed in priorto actual date. Apart from this, every annual leaves taken were in factbeen approved in advance ahead of actual date.

Therefore, on this matter, I wish that you provideme the record and proof via my punch card to substantiate yourallegation the first of the two reasons.

On the matter of my unsatisfactory performance, Iwish to state thatnever in the time of my service to the company, wasgiven a written target tojudge my performance. As a marketing executiveof your company, my primaryfunction was and is to promote the greaterawareness of the Fairon AluminiumComposite Panel to architects,developers, quantity surveyors and end usersthrough specifying works. Iwish to reiterate that I have never been given anyspecific targetexcept that I have always maintained my best efforts during thecourseof my works at the company. From all the daily visitation reportsandmonthly reports of project listing and forecast submitted to mysuperior eachmonth has proved that I have done all the given tasksarranged by your companyand therefore, I consider that the tasks andworks done by me were satisfactorybecause I have never been reprimandedthrough warning or caution eitherverbally or written.
I also wish tostate that I have never been informed of any guideline or barometer to judge myperformance by you.




While I am already very frustrated by the latepayment of my salary and claim each month, and to certain extent, eventhe contribution of my EPF by your company is always late behind time, Iwas willing to forget and make sacrifice in order to assist the company.

Again, I wish to inform you that I am disputingyour termination of my service by the sole reason that I was and havenever been reprimanded by you while carry out my duty in the company.And such, I am allowing you the opportunity to cancel the terminationletter or otherwise I may seek legal counsel and representation todispute your action in the court of law.

请问怎样才算 lack of capability?
一 target 来计算?
那么要hit到多少%  或 sell 少于到少 % 来计算?
还是老板说的算?

我的公司老板没有讲清楚....offer letter里面没有讲到我需要 hit target...我的 job title 是marketing executive, 我的工作纲要主要是servicing,promoting and product awareness...在我interview的时候也讲清楚了.....他从来没有讲要换我的job function

好啊(you asked for it), 就纠正你

刚好相反, 这叫 “unfair dismissal”,

当员工告公司“unfair dismissal”, 上工业法庭时, 是由公司来证明 “dismissal is with just cause or excuse”

没有 “任何的警告信”, 公司很理亏, 很难证明 “dismissal is with just cause or excuse”

LZ, 尽快 向 Minister of Human Resources 投诉吧

听说是旷工和无故缺席,公司是可以解雇员工而不许要警告信......我不太确定...如有不对的地方,请你们纠正一下...

如果没错,公司在解雇你之前应该要有一个enquiry来给你机会辩护自己
好像楼上说的,可以去那里投诉,他们会调查的,不用你自己请律师
