对了,你几岁?超过18岁?我roughly看了employment act 1955,termination relevant 的 section,section 10(3)
(3)The notice to terminate the service of a person who is employed under a contract of service shall be not less than —
(a)one day’s notice if he has been so employed for less than 26 weeks;
(b)one week’s notice if he has been so employed for 26 weeks or more but less than 2 years;
(c)2 weeks’ notice if he has been so employed for 2 years or more but less than 5 years; and
(d)4 weeks’ notice if he has been so employed for 5 years or more.
你有给notice吗? 1day notice就可以了,如果你的employment少过26 weeks。 |

过18了,想问你看得employment act 是最新的吗?
因为最新的employment act是说工作超过两年要给四个星期通知哦。。
有给notice,一天咯。

我看的 employment act是2006 version的但这 statue都没什么 revise。如果要看 latest的去任何一间书店都可以查询。 mph kinokuniya肯定有。

可是无论是我亲自去劳工部或打电话去putrajaya问,他们给我的回应都是我没给一个月notice所以错在我这里,老板做的那些事是另一个case。就算我做aduan也要证据,而且我现在什么打卡都没有。
那天那个officer show给我看得是最新的,说少过两年要给一个月通知。
我那天上网找也说要给一个月通知。
有一天去书店看到最新的employment act,也说要给一个月通知。
打去putrajaya也说要给一个月通知。
所以可能你看得真的是旧版的?
我应该没胜算了.. |

劳工部的官方网站也有放 employment act的 statute。你去看 section10怎样写,如果是一天的话你 print出来然后拿给劳工部看。 |

我到labour department官方网站看了:
Section 12(2)(a)
(a) four weeks’ notice if the employee has been so employed for less than two years on the date on which the notice is given;
看来你不能用这个ground来defend。你有什么ground show that你的employer breach of the employment contract? |

我觉得如果他已经breach of contract by asking u doing ur job not relevant to job description。其实black and white只是supporting document而已。不是compulsory。好像她叫你做accounting job,没有那个必要用black and white来叫你做啊。如果labour court ask u go for hearing,那么你能自辩,当场说出你的reason,当然court也会当场质问你的老板有没有这样叫你做,当然大多数的人在court都不敢说谎的。
最坏的打算是:
Section 13(1)
Either party to a contract of service may terminate such contract of service without notice ... by paying to the other party an indemnity of a sum equal to the amount of wages which would have accrued to the employee during the term of such notice or during the unexpired term of such notice.
他还欠你1个月的工钱?让他offset掉,这是最坏的打算。RM800? |

还有,他不能forfeit你entire month的wage就算你proven breach of contract at first。 |
