我看他大前天還高高興興跟老婆去看戲，然後昨天去看球賽

現在我出了 letter of termination of contract without notice 給老闆簽
內容講他 email 說要 resign 但卻 5 天沒來上班
然後 by labour law 若是沒跟 notice 來 serve 的話要賠另一方薪水
再者超過兩天以上沒來上班（沒申請 + 沒讓人接受的理由）就當作對方 broken contract of service

老闆看了以後反而擔心對方會拿著這個信去 labour office 講我們 terminate 他兼不賠他薪水

我猜想他是找怕找不到工
因為他 email 講要 resign 的前一天有接個電話，我聽到好像是問關於工作的東西
當時只見他慌慌張張跑出去回答

剛剛 manager 講起之前 interview 的時候原本不打算請他
但他每隔幾天就 sms 問 manager 怎樣，會不會請他
manager 覺得他那麼積極就請他試下，只是沒想到上班後會是醬的款

我準備的信件內容

We acknowledge receipt of your email notice of resign dated 6th December 2012, it has been confirmed that you have proceeded on leave without prior permission of the concerned authorities for a continuous period of 5 days, resulting in willful insubordination and gross negligence of duties, in your capacity as Project Engineer.

Under Employment Act 1955

13. Termination of contract without notice

(1)    Either party to a contract of service may terminate such contract of service without notice or, if notice has already been given in accordance with section 12, without waiting for the expiry of that notice, by paying to the other party an indemnity of a sum equal to the amount of wages which would have accrued to the employee during the term of such notice or during the unexpired term of such notice.
(2)    Either party to a contract of service may terminate such contract of service without notice in the event of any willful breach by the other party of a condition of the contract of service.

And

15. When contract is deemed to be broken by employer and employee

(2)     An employee shall be deemed to have broken his contract of service with the employer if he has been continuously absent from work for more than two consecutive working days without prior leave from his employer, unless he has a reasonable excuse for such absence and has informed or attempted to inform his employer of such excuse prior to or at the earliest opportunity during such absence.

Absenting yourself from duties without prior intimation is a misconduct for which you are making yourself liable for being terminated.

剛剛跟老闆談了，老闆擔心對方拿著那張 letter of termination of contract without notice 到 labour office sue 公司 terminate 他且沒有賠他薪水
所以老闆叫 manager 跟對方談，叫對方開一張 back dated 的 resign letter（06/11/2012）然後注明給 one month notice
醬 01/12 ~ 06/12 的薪水依舊出給他

为何不要先把这个case report to labour office询问他们说公司可以采取什么行动？

至少问了有底，好过没有问啊
可是好像也听说过malaysia那边的确是比较side employee的（可能也有参杂种族因素）

所以老闆說那幾天的薪水才幾百塊錢，他不介意，就出給那個 project engineer 好了
他說他不要且不得空上 labour office
