when you buy/sell EURUSD you are buying FX Premium Instrument .

EURUSD or USDJPY or GBPUSD is not a currency it is instrument.

EUR or GBP or JPY is currency since it has physical existance.
But EURUSD is not a currency since it has no physical existance .... it is Exhange rate.
Forex broker offers Exchange rate instrument not Currency.

其实，国家银行也没有明确的指出不能在网上交易外汇或者是margin trade，可能他们应用phyisical trade 的条 ...

No. Residents are not allowed to trade currency through internet. Residents are only allowed to buy or sell currencies in Malaysia withauthorised dealers and those entities permitted by Bank Negara.     外汇市场是全球最大的金融市场，只是怕你在非法经营公司开户而已，
   税问题可以 ...

    这位仁兄已经答对了，个人交易是合法的。经营公司开户是非法的。外汇交易得来的盈利是不需要缴税的，
因为属于capital gain就好像炒股票也不需要缴税，但股息要。但如果你从外汇交易赚到一千几百万，
避免和我们伟大的政府有冲突，就去会计行叫他们帮你报钱从哪里来。你可能要print out statements作为证据。

    可能我说的不够清楚，政府不允许的是：不能经过互联网买卖外汇。意思说用马币买美金或其它的。
因为这样会导致大量的马币外流，影响了国家的汇率。很多国家都不允许的。

而我们做的交易是牵涉到我和我们的broker罢了，因为有levelage的关系，所以我们所谓的投资金额其实是叫做“保证金”。
如果我们叫做外汇投资我们就赚咯，你放1000美金却可以买500,000美金（500倍 x 1000美金）的英镑或其它的。
那卖掉后你得到多少？ 1000还是500,000?

真正在买卖的人是我们的broker，所以它需要该国国家金融管理局发放的执照(美国的FSA等)。我们的国家是不允许开broker公司的。

           Free to invest in foreign currency assets
with domestic ringgit credit facilities

with own existing foreign currency funds;
up to the full amount of permitted foreign currency credit facilities; or
up to RM1 million in aggregate per calendar year if funded from conversion of ringgit

条列二
Dealings in gold and foreign currency.        4.   
(1)   Except with the permission of the Controller, no person, other than an authorized dealer, shall, in Malaysia—        Act A1241.
        (a)        buy or borrow any gold or foreign currency from;          
        (b)        sell or lend any gold or foreign currency to; or          
        (c)        do any act which involves, is in association with, or is preparatory to, buying or borrowing any gold or foreign currency from, or selling or lending any gold or foreign currency to,

Advertisements relating to dealings in gold and foreign currency.        4A.

看大家很困惑，根据BNM查证，网上保证金外汇交易是合法的，不过风险自己承担。

通过条例一，我们可以通过本地银行，直接转账且转换马币成外币用作投资用途。限制是每年RM1million.
至于网上保证金外汇交易，是属于投资吗，我想是的，因为它不是真正的外汇兑换。
网上保证金外汇交易，Option,股票，Fund，房地产，这些都是投资类。BNM说，要小心罢了，自己承担风险，BNM不会负责。

条列二，旨在说明，任何外汇交易是要通过银行或合法兑换商。（实际的金钱）
而那位犯法的人，应该是收取了别人的钱，然后转钱之类的。（如local deposit）
所以只要有收取别人的马币然后帮忙转美金，就要特别小心，是犯法的。因为你已经成为非法兑换商。

条例三，黄金和外汇的广告是非法的。所以，什么讲座，有关于投资外汇，黄金的最好特别小心。
最近马哈迪，推介一间黄金投资公司，他说现在投资黄金最好了！！他犯法了吗？？

很简单，如果你在外汇亏钱，去投报给政府。

他会对你说，拿钱去外国公司投资，本国一律不负责任。

如果你在外汇赚钱，他们就会去你家按铃门，对你说：请跟我们回去警察局一趟~
