1)what is the legal position if there is a conflict between the provisions of the employment act 1955a nd any term in an employee's contract of service?assume that such employee is covered by e.act1955.

2)what are  the three trademark group?explain what they are.

1. 考试不需要知道这个~~~
2.notes里面有~照着写~~~

2.three trademark groups:
(a).Ordinary trademarks which are words, or symbols marks associated with a good or service and held by individuals or organisations.(e.g. MAICSA and its logo and symbol.)

(b).Certification marks are names or symbols used by organisations to identify quality in a good or service.E.g the mark Sirim to identify goods that satisfy the certification authority on and about safety levels.

(c).Distinquishing guise also commonly known as 'get-up' which identifies a good or service by its physical representation e.g its packaging or physical shape.KFC with its standard design, colour theme and setting for its outlets is a classic example. Also Petronas with its distinguishing colour, outlet layout and design intended to create the distinguishing elements.
