Apple is suing rival company Samsung for allegedly copying the design of both the iPhone and iPad.

iphone的製造商蘋果公司正式入稟美國法院控告韓國三星公司抄襲其iPhone和iPad的設計。


Apple claims that Samsung is guilty of "slavishly" copying various aspects of the iPhone and iPad, as well as the Apple iOS operating system.

蘋果公司指責三星“毫無顧忌的”抄襲iphone以及ipad的各種主要功能與外在設計，尤其是她獨特自主研發的iOS手機操作系統。


In documents filed at the US District Court for the Northern District of California, Apple outlined 16 claims against Samsung; including trademark infringement and patent claims.

在給予美國加利福尼亞州北區聯邦法院的控狀書內，蘋果指出三星的16宗罪狀， 包括商業和智慧資產侵權。


The claims relate both to the physical design of Samsung's products, as well as alleged similarities between the user interfaces. The case relates to the Samsung Galaxy Tab and the Samsung Galaxy smartphones, both of which use Google's Android operating system.

所有的控狀都圍繞在三星智能通訊產品的外在設計和用戶介面與蘋果的產品有諸多相似之處。尤其是使用GOOGLE ANDROID操作系統的三星GALAXY TAB以及GALAXY智能手機等。


In the 373-page document, which includes photographic comparisons, Apple notes that Samsung has made its Galaxy phones and tablet computers "work and look like Apple's products". This was achieved, Apple claims, through the "widespread" infringement of Apple's patents.

在長達373頁的控狀書內，蘋果利用許多圖片來比較兩家的產品，指責三星“把她的產品設計的跟蘋果幾乎一摸一樣”。蘋果也聲稱三星“完全的，廣泛的侵犯”蘋果的智慧財產權來達到這個目的。

The suit also claims that Samsung has "misappropriated Apple's distinctive product packaging".


控狀也指出三星“竊取了蘋果的獨特產品包裝，好讓其據為其有”。
Samsung has responded bullishly, saying that its products are the result of its own research and development. In a statement the South Korean company said: "Samsung will respond actively to this legal action taken against us through appropriate legal measures to protect our intellectual property."


三星日前強烈否認抄襲指控。并再三強調其所有商品都是自行研發得來。其發佈的通告指本身將慎重的看待此事，并將竭盡所能的保護公司產業。

This isn't the first time Apple has sued a rival company. In March, Apple sued HTC over alleged patent infringement relating to the iPhone. Also, in October of 2010, Apple sued rival smartphone manufacturer Motorola.


這已經不是蘋果第一次控告其競爭對手了。2011三月，蘋果控告HTC侵犯蘋果iphone的版權， 去年10月，蘋果也對MOTOROLA公司旗下的手機設計不滿，而採取了法律行動。

TOUCH SCREEN本來就不屬於任何廠商，而且TOUCH SCREEN phone是HTC發明的！

如果侵犯版权的话，是绝对可以告的。

不告最直接的原因肯定是没有利益可言，费时费钱，赔了夫人又折兵。

我都不明白ipad有什么好。。。

我不是apple的忠实用户，
可是我在用着它们的ipad,
我个人觉得很好用！起码我要用到的东西，apple的apps 有而Android 没有！！
(也许Adroid迟一些推出也不定，只是现在还没有）

老实说，Samsung Galaxy S II的外形实在是和Iphone 很像！
我也有考虑Samsung Galaxy SII, 还未定。因为我不喜欢它的Super Amoled...太过Saturated...可是Spec 很吸引我

本人還是比較喜歡SAMSUNG
現在我家裡有2個人用SAMSUNG電話，還有一個電視
今天才剛去了IT Fair 我大姐終於拋棄買ipad2 的念頭買了GAlaxy Tab（萬歲！）
Samsung萬歲！完全喜歡它！打到apple吧！！去死吧！！
