买卖合约with tenancy

一年前,我们买了一间shopping mall shoplot. 当时,还有至少一年的tenancy.

但是,拖拖亚,今年七月才settle.(Bank released balance payment) 但是,当我们takeover 时,tenant 已经要early termination. (contract expire Sept 2012)

Since early termination, I request the owner to give back 2 months deposit to me as the early termination penalty.

But, my laywer told me that seller lawyer has defaulted in payment and the seller has used the deposit.

So, as a result, we with the original intention of buying this shoplot with ready tenancy, we ended up with no rental income after bank finally released money.

Can somebody advise whether I can get back my rental deposit?

Besides, I also want to complaint my lawyer because of her office internal issue that cause my case to be dragged for so long. Kindly advise on this.
