Evaluate the rule of law and the doctrine of separation of powers on the development of the laws in malaysia

你需要知道Rule of Law和Seperation of Power的theory，然后来衡量这两个doctrine对大马的（法律方面）发展有什么影响。。

Rule of Law你可以看看AV　Ｄｉｃｅｙ的ｉｎｔｅｒｐｒｅｔａｔｉｏｎ。。是最普遍的。RoL, Dicey's interpretation:
1) No Breach, No Punishment
- There can be no punishment carried out to any individual without any distinct breach of law.

2) Equality before law
- compare and contrast with the current M'sia application..Share, my favorite quote: " BE YOU EVER SO HIGH, THE LAW IS ABOVE YOU"- L. Denning in Gouriet v. Union of Post Office

3) Courts are Better Protector of Rights.
* Refer to TS Allan and Joseph Raz's interpretation of RoL too.




Seperation of Power
Refer: Montesquieu's idea, but do not rely solely on it.
3 Main organs: a) Parliament, b) Judiciary, c) Executive.
Should there be overlaps? To what extend?
OR
Should there be strict seperation of power? How and Why?
