under probation 有假期可以拿吗?

我的PROBATION是留六个月, 而我工作了4个月半....要RESIGN, 需要2个星期NOTICE.
请问我entitled claim paid annual leave 吗? 如果算.....那么我总共有5天假期.

我之前的公司有。
现在的公司是没有。
所以现在的公司，如果under probation,拿leave是拿unpaid的。。。

如果你under probation可以拿annual leave那照理是可以扣。

我想应该是没有的CLAIM...如果是ACCORDING to labour law i am not sure....

有的, 如果在probation就炒老板鱿魚, 公司應該要把你的 leave 還回錢給你.
但是也要看公司的policy 可不可以用 leave 來 offset notice period.
拿 policy 來讀清楚.

letter offer的作用就是要避免labour law 和 公司的Policy
出现分歧，所以一切还是必须尊从letter offer的 clause,
如果在letter offer 没有提及到的，那么一切就得遵从
labour law 所定下的。

如果依照你的letter offer, 你是不entitled 年假的，
但是你还是有权利向人事部询问。

一般现在的公司都不会让probation period的员工
得到年假的福利，因为年假是一种福利。

我也是有這種問題耶 我的公司是六個月probation period 但是前面三個月不能拿假 過了三個月就可以拿年假 我也是要辭職 明天準備丟信 不過還沒有找到工作 只是覺得待不下去了 請問大家是找到工作才丟信嗎

各位, 谢谢你们的意见...今天我问了律师(LABOUR LAW)在EMAIL 上告诉了他我的状况.
他说我是可以拿的, 最后他告诉我的就是:

The law is about "employees" and is not concerned whether you are
probationer or not.


In that case, the  following subsection of the EA may be helpful to you:
"(2A) Notwithstanding subsection (2), upon the termination of an employee's
contract of service, the employee shall be entitled to take before such
termination takes place the paid annual leave due to be taken in the year in
which the termination takes place in respect of the twelve months of service
preceding the year in which the termination takes place, and, in addition,
the leave accrued in respect of the completed months of service during the
year in which the termination takes place."
